Got Boned on the Highway

Weird accident yesterday....

Was cruising on the highway at 65mph when out of nowhere I get slammed from behind by a jeep cherokee. Everyone was OK but now my Genesis needs to go in for some repair. Not the best time of year to have this happen...

The kid must have been going 90mph.....

To top it off, I drove the car home to take my truck to work and it had a flat tire... At that point I decided to stay home and work remote.

Get a nice rental car and don' t take less than a perfect repair. Don't forget about diminished value. Glad no one was seriously hurt.

I plan on keeping this girl for as long as possible... I want perfect! I actually have a body shop guy coming to look at it today in my driveway. He's local so no big deal for him to swing by.

As for rental, thats something I have to work out with the guy who hit me insurance co. I'm not really sure how much they are going to push back. I don't carry rental on my policy because I own another vehicle. I do want a rental though....

Any advice?
 
They should give you rental starting when your car goes to shop. The rental should be comparable to the Genesis, nothing less. Stand your ground, tell the insurance company what they are going to do for you, nicely but firm and unyielding. Don't accept aftermarket parts. As for injury claims, ask who to contact and ask for the supervising adjusters name, and email. Do all negotiations in email or writing. Confirm conversations in emails. If they say something like "that's not our policy " then ask for a copy of their claim policies and procedures.
 
And NEVER sign off on injury release, ever.. Until, the car is exactly as you want it, and you are sure your neck or whatever does not have something chronic that shows up later.

I have a relative that thought she was not hurt, and signed a release. Only to then have a neck-spinal issue that was traced back to the accident.

She fought and never got any compensation because of the release..

After that, in her job she stresses the injury, took pain meds, and got addicted. Had to get over that. Today still lives with pain. And her rear end accident was about as bad as yours.

My .02. I am not saying get something for no reason.. Keep the leverage until the car is correct and you are really sure you are ok.

I'm curious to know how much my insurance company thinks its going to cost for the fix. They always low ball it, then they have to come back out again and do the appraisal all over again...

Why deal with your insurance company. I always get a rental car immediately then contact the at fault person's insurance and tell them who to pay and tell them I will keep the rental until my car is back same as new. I never get my insurance company involved unless the other person has no insurance. I have to have a working, operating trunk that is weather tight so an accident like yours would mean the car would be of no use to me(hint, hint).

Why contact my insurance company , other than notification, when the other party has total liability? Maybe a Lawyer for guidance, which I have done. I never want to have any out of pocket cost, and always want to put all related cost of crash on the other person. My family has been through crashes at least 14 times, the last time was when a full size SUV hit my son head on while it was traveling the wrong way on a four lane divided highway bridge. Both cars were totaled. My son was lucky and only had bruises and cuts. The other guy was DUI and ran away on foot and was caught and arrested minutes later running along the four lane highway.

Here in Massachusetts we have screwed up car insurance laws...

My insurance company will actually pay to have all the work done on my car and then they will turn around and get reimbursed from the other insurance company. To be totally honest I've never done this before but so far my insurance company has been great. I had the appraisal done the same day as the accident and they assured me everything would be fixed. They do all the dirty work to get their money back from the other insurance company which is great - the only thing I need to do now is contact their insurance company about paying for rental.... but the shop who is going to do the work actually just called and said they would take care of that phone call too.... So I don't have to do much of anything now... which is great!

Lets see how this all plays out... I'll let you all know.

Another reason to contact your own carrier are limit issues. Many times the amount of damage exceeds the amount of the state required coverage limits.

The other party's carrier will not pay more than the coverage limit.

Because everything in MA is "No One's Fault". Thats why we all pay out the nose for all types of insurance... Wouldn't it be nice one day to just live based of your own decisions and actions?

I hear your complaint - These "no-fault" states include Colorado, Florida, Hawaii, Kansas, Kentucky, Massachusetts, Michigan, Minnesota, New Jersey, New York, North Dakota, Pennsylvania, and Utah.

I've never known anything but the "no fault".

ASH, good luck on the situation. The Genesis is a bad-ass car. I still love my 2009.
 
I'll take no-fault auto insurance every time. Had it in NJ; don't have it in VA. Who needs to be chasing the other guy's insurance company around. Not to mention all the uninsured drivers on the road.
