I looked through my warranty manual the other day. You will be bound to binding arbitration (arbitrator likely picked by Hyundai) if a warranty dispute arises. No legal recourse allowed.

HOWEVER, if you send a certified letter to Hyundai within 90 days of your purchase, you can opt out--------which I have done.

Hope it never gets to that (no real problems to date), but you should preserve your options. You can always agree to arbitration, but a lawyer (or the threat of one) may be useful also.

That is typical of almost all manufacturers, actually the fact you can opt out is rather unusual. I speak from experience, having returned a Mustang through lemon law proceedings. Of course this may vary state to state. In California you must go to a stacked arbitration board but then can continue if unsatisfied.

In NY, it is illegal to pick an arbitrator that favors one party over another. The arbitrator must be mutually agreed upon. Yay NY? haha

If you file the case with the BBB Auto. they are the company who pick the
arbitrator. one nice thing that I found out is that Hyundai does about 75% what is called goodwill buyback.

Many companies will ram this BBB arbitration nonsense to customers because it is friendly to the company--after all, it's a lobbying organization and that's a benefit of joining. So the guise of the BBB looking out for the little guy is a fallacy. I cannot begin to stress that enough based on past experience.

I have heard it said that, although not all members of the BBB are crooked, every crooked business is a member of the BBB.
 
FYi - when I purchased a VW Passat last year (June) I had nothing but trouble with both the vehicle & the *Dealership..
After much to-ing & frow-ing with VW of America with no real satisfaction, I finally contacted the BBB CA, within 48 hours VW of America contacted me & authorized a New vehicle..
((*The Dealership -> Merced Hyundai/VW/Kia Merced CA.. (Drive Past Fast))
I purchased my new Genesis from -> Central Valley Modesto CA..
These guys are True Professionals and dedicated to Customer Satisfaction.

The BBB was totally incompetent in my issue with Ford. I wrote a lengthy response to a supervisor in Virginia and never got a response. Sold the POS and took the hit. I thought about going to small claims court and take my chances with filing a complaint for the loss difference.
 
Hi, well the BBB worked for me within 48hours..
A bad 2012 Passat SE..tried everything with both VWOA & the dealer (who was pure krapp) --
Called the BBB and within 48hours VWOA had agreed to replace the vehicle with a New 2013 Passat Top Spec..As the replacement was worth considerably more than the original I traded it for the Genesis..
My year with VW was a complete nightmare, every other day another rattle, squeak or electrical issue.. My days off where spent living at the VW dealership
getting the as I called it "KitCar" put together...
The VW & Hyundai dealership -> CentralValley Modesto are absolutely fantastic.. 110% for customer care & service..
(VW/Hyundai/Kia Merced CA are best avoided..Poor QC & even poorer customer service)--They have more tricks than a Bag of Monkeys"":eek:

I don't know about civil suits with car companies but in the world of small businesses I know alot of them insist on binding arbitration because the large company can drown you in legal bills with the use of their in-house salaried lawyers and you have to pay by the hour. A lot of people don't have the deep pockets to pursue a legal remedy in court.

Just send a letter saying you are opting out of the binding arbitration. The address is in your owner's manual.

You can also (supposedly) do it on online------the web address is also in your manual.
