Will 245/40/20 fit my 09 Genesis or does it have to be 245/35/20?

Yes they'll fit you'll just be gaining a bit more sidewall and on 20 inch rims this may cause slight rubbing depending on your offset
 
The 40 series tire will fit just fine. One thing to consider:

In general, you want to stay within 3% of your original sidewall diameter when changing tires/wheels for an accurate speedometer. The difference between your 35 vs 40 series is 3.6%.

With the new 40 series tires mounted, this means when your speedometer shows 60mph, your actual speed will be 62.16mph. It's not a big deal unless the slightly inaccurate speedometer/odometer bothers you.

Yup very correct they fit perfect. Thanks. That being said will 255s fit? Or will the front need modifications so it doesn't rub?
Again depends on front wheel specs

Will they fit yes. Is it necessary? Probably not haha
