GV70 Will Not Start

Four months after purchasing my CPO 2023 GV70 3.5T Sport Prestige with 18,000 miles on the vehicle it stopped starting and is giving the DTC P2B9500 code. After googling the code and not finding much it appears to be a rare issue. I work for Kia and after speaking with colleagues at my dealership we suspected the alternator.

However after sitting for 5 weeks at my local Genesis dealership where the technician tried replacing the battery and fuel pump (neither got the DTC to clear) and doing several tests the Genesis Tech Line suggested, he finally ordered a new floor wiring harness - of course it’s on backorder until the end of November. After speaking with the technician working on it I got the impression he’s just guessing at the source of the problem so hopefully that fixes it. Has anyone else had this issue?

At first I assumed I just got a lemon. However my local Genesis dealership just informed me that my GV70 was used by the other Genesis dealership I purchased it from as a service loaner. They never disclosed that to me and it didn’t appear on the Carfax so obviously I bought from an unethical dealership. Because of that my local dealership told me I’m not eligible for the complimentary 3 year maintenance. Is that true?

If the selling dealership sold it to you as "new" then it has also violated federal regulations:


The rule states in part: "Previously titled or not, any vehicle driven for purposes other than moving or test driving is considered a used vehicle". So if it was used as a service loaner, it should not have been sold as a new car and any car dealership should be well aware of the rules. There are many implications of much greater import than the loss of free maintenance: for example...the loss of part of the new car warranties.

So assuming you have paperwork showing you purchased it as new (what does the paperwork say about the odometer reading?), and paperwork demonstrating its prior use as a service loaner, I would demand recission as it was at best a materially erroneous sale and most likely a fraudulent one. Again, assuming the paperwork lines up, I would go back to the dealership GM and tell him what you have found and it was clearly erroneous and you are coming to him because you are confident that this is not the kind of activity he would approve of and you believe he will fix it for you. You are essentially giving him the chance to do the right thing without any claim of fraud. If he declines, then you should probably tell him you are going to reach out to the state attorney general and motor vehicle department regarding a fraudulent sale and after a week or so, do exactly that. Depending upon the responses you get, you should possibly contact an attorney as well.

If the paperwork doesn't line up, then it becomes dicey.

It was sold as a Genesis CPO - but they did not report it as a loaner/rental as it did not say that on the Carfax.
