Smart Cruise Control dead at 38k miles

Rather than cruise, which I never use, my original warranty concern was the Nav system, and I was assured verbally by Fidelity that "nav is included with audio," even though the contract does not address nav explicitly. I was a bit doubtful, but decided to purchase the Platinum plan anyway. Sure enough, the nav went out after 36 months had elapsed and the warranty did cover the replacement of the head unit.

The nav was one of the reasons I bought the platinum coverage, but I realize now that there are lexicon head units all over ebay for just a few hundred dollars

How do you know they work, and how much to install them?

As mentioned before, the Hyundai website on warranties does not exclude the Smart Cruise Control from the 5-year / 60K mile warranty, so what is the status of you getting this straightened out with the dealer?
 
It's been over a year since i read it, but I believe that the Fidelity backed warranty plans literally cover everything except consumable and wear and tear items, but the assurant ones were more limited.
I was offered the Hyundai name brand warranty (by assurant at the time i purchased) or a warranty through fidelity. I went Fidelity.

If it doesn't work I'd just return it to the ebay seller (this is all assuming one checked the return policy and bought from a reputable seller). Installation looks easy - you just pop out the trim piece around the CD slot and there's the head unit.

The service adviser told me that he has to email some sort of warranty inbox for items above $1,000 but that he thinks I should be OK. I think that I just thought it was covered under the 3yr/36k warranty, which has since expired.
