Trunk opens with out key fob

Did any have this problem. Trunk opens with out key fob. I just touch the trunk rubber with the key fob in the house and the trunk opens.

2012 4.6, with less than 2,400 miles.

if was the car was unlocked the trunk remains unlocked. if the car is locked the trunk will be locked.

Yup, same as my 2009 V8/Tech. If the doors are unlocked all electric based locks are unlocked. So the trunk opens from the under-lip pad or the button in the driver's door. This assumes the pushbutton in the glove box is set to allow electrical operation of the trunk. If that pushbutton is OUT, the trunk won't open from the driver door button nor the under-lip pad even with the FOB nearby.
