genny gets badly rear-ended ...what now ??

the damage extends into the rear corner panels. the trunk, bumper and underneath the rear end looks pretty bad as well. some a## hat in a old 77 mercedes wasn't paying attention and rear ended me while i was stopped - he was going at a pretty good rate of speed.

kind of a shame because the car- 2009 4.6 w/ tech- only has 60k on her. oh well, now it's time to decide on maybe getting a new 14 or 15 and trading it in. of course the car will now have a "diminished value" since it was involved in a major accident, so i need to make sure i find an appraiser to determine the diminished value. if you as a 3rd party are not at fault, the insurance company is legally obligated to pay this. of course they don't tell you this because they save billions every year.

at any rate, it might be time to look for something new.

Your car could very well be "totaled" by your insurance company. That would be your best possible outcome, so keep your finger's crossed and go price a '13, or '14, right away. Sounds like your '09 saved your butt in the accident.
 
Well I know for a fact you can get a 2013 R-spec for around 37 grand. They are trying to get them off the lots.
 
I agree that the car may be totaled by the insurance Co.

thanks guys. ya i'm ok outside of a sore neck, but the car did really well w/ absorbing some serious impact.

now i have to decide on a possible new 14 rspec or i was thinking maybe a used low miles certified 2012 550 and put a dinan S 2 on her. lots of choices out there.
 
Hard to total a car from the rear. All the expensive items are located up front. When I had a body shop a car was totaled if the cost of repairs was 80% of the retail cost of the car. Now that was 25 years ago so it could be different now.
 
I would contact a lawyer about this. A sore neck may be an indication of more serious injuries than think.

I agree that one should see a doctor, but it is important to act fast with regard one's legal rights relative to the other driver's insurance company. I was rear-ended years ago and had a sore neck after the accident, but found at much later that it caused permanent damage that now restricts my head movements. I believe my personal doctor at the time was more interested in appeasing my medical insurance company than in doing what is right for my long term heath, and many doctors gets dinged if they authorize too many specialist referrals.

Personally, I do think there needs to be caps on the dollar amount for personal injury lawsuits, but a neck injury can be more serious than it might appear.
 
My coworker who has a late model Mustang was rear-ended a couple of weeks ago.
When consulting with his own lawyer who advised him if he wanted to file a medical complaint, do so ASAP (ideally at the time of the accident). Otherwise his chances in court are pretty slim proving it was caused by the accident in which he was involved in.
But he did say the other guy's insurance (who at fault) promised to taking care all the repair expenses and some which he hopes big enough for him to put a nice deposit for a 2015 Mustang.

Get to your doctor and get checked out ASAP. Then contact a lawyer. My son had an elderly lady pull out in front of him while riding his motorcycle and he had injuries and they paid out very well. Don't sign anything from either insurance company until you speak to an attorney first. Most importantly (as noted above), get checked out by a physician.
