well that didn't take long, damn kids and their flipping phones

texting 20ish year old dumb ass rear ended me this morning..

rush hour traffic, stop and go.. a little pickup and we went from 15ish to 50ish then back down to a stop, idiot hit me at speed while I was stopped, never even slowed down.

I had auto-hold on, and the G80 didn't even budge. Kids 25 year old Acura Integra POS bounced off the car.

his POS was lowered so it hit the bottom half of the bumper, broke the rear diffuser, shoved the faux exhaust tips in, and broke the center backup sensors I think as they aren't picking anything up now, also appears to have damaged the blind spot sensors as they are stuck "on" right now showing the lights in the mirrors and HUD.

Showed me an insurance card, but it expired 3 months ago, hopefully it was just an old card he "swears" he has current coverage and will get me the card. My insurance said they can find out, but are handling it as uninsured motorist at this point.

Sorry to hear, man. There are a few of us that know what it feels like to have these cars away for obvious reasons. Let us know the progress and result pictures. Pick a shop you trust, you will quit knuckle-shufflin' mid stroke knowing something may have been done incorrectly. Don't ask me how I know...
 
Ughh - feel for you Mr Inc.!

This is the reason why idiot-proof (or nearly idiot-proof) tech like AEB is making inroads.
 
So upon further inspection the spare tire area under the trunk was pushed into the car and folded, the spare tire is jammed in and the battery is sitting at an angle and is no longer secured in place, I disconnected the battery and won’t be driving the car. Center rear park sensors aren’t working nor is the auto open trunk or the “lock” button on the trunk lid which tells me the array is damaged (maybe this repair will fix the issue I have with it). Exhaust tips on the actual mufflers are bent as well.


Went back to body shop and pointed this out and estimate has jumped to over $7,000. Douche bag texting boy does have insurance but it is the state minimum insurance. I.e. $5,000 property, so I will go through my insurance to get the repairs done.

Not only am I pissed and depressed over my new car now being in the moderate to severe damaged category, I can’t drive it. Frankly I don’t even want the car anymore, because I know there will be squeaks and rattles and groans after the repair, and don’t even get me started on the diminished value angle.

Man, that is bad. I'm hoping for none of that on mine. I understand your feelings as I'm also thinking of the least financial hit to trade in. Maybe a 2020 is in my future.

My 2018 is my third "last car" possibly at my age, but after getting hit I'm rethinking that.
 
If you’re not ready to give up find a trustworthy shop to fix it. I found a good mechanic who took their time and did it right when a drunk ran into my Challenger Scat Pack Shaker. What a shame.

oh that's painful to look at..

mine isn't that bad, and if the car was 2-3 years old I wouldn't feel so upset about it, but it's not even 3 months and doesn't even have 3,000 miles on it.

In your case, I was also surprised about the minimum insurance required. Knock over a mailbox these days and you are near the top end, let alone hit a car less than 15 years old. Must be rules not updated since 1968.

Yeh,had the exact same experience,didn’t have 3000 miles on her and WHACK! just felt like crying!!!

As of 2018 all vehicles are mandated to have emergency braking. .

Do you have any information on that? I have never heard about mandating emergency braking only the voluntary agreement some care makers made to have it as a standard feature by 2022.

little damage showing, quite a bit of damage underneath the car, the spare tire bucket (where the battery resides) was severely damaged, body shop said normally they would put it on a frame puller and straighten it, but because the metal is creased in half and split they will have to cut out the part and weld in a replacement.

This concerns me because having seen this type of repair in the past, it is susceptible to rust, leaks, and other issues, and having the battery back there makes me more concerned if the reweld and reseal is not done correctly.

I am just going to have to wait and see what happens, but I am not happy about having to have this level of work done on a 2.5 month old car.

Why isn’t this car a total loss? You should be concerned. Getting the frame right is no simple task. Did you lobby to have it declared a total? It’s hard to believe that this is only going to cost $7k considering there must be a fair amount of body work plus electronics.

no frame damage, damage is to the spare tire well, which is a separate part, it is a sub-part of the chassis

since the damage/cost is not more than 50% of the value of the vehicle, a total loss won't even be a consideration at this time, it is considered "moderate" damage, 1 step up from minor, 1 step down from severe.

this is the part that is in question, it is listed as part of the floor assembly:

and while the body shop and the insurance company see this as "no big deal", I see it as a huge deal because of the age of the car, if the car was 3-4 years old and I was about ready to trade it in I wouldn't care, but being 2 months old my mindset is that I am now going to have possibly deal with issues arising as a result of this accident for the next 3-4 years that I will be keeping the car.

I could sell it now, but I would take a loss about $15K in depreciation and diminished value.

the whole thing is $h1t anyway you look at it. Maybe the repair will be done so fantastically great that it looks new and like nothing ever happened and maybe I won't have other issues arise in the future, and maybe the world will end tomorrow. i.e. I won't get my hopes up, I'm a realist, and I've worked in the automotive industry and built several of my own cars over the past 30 years, so I know better.

I already have squeaks and groans that weren't there before the accident, I'm betting they will not go away with the repair, it will be an ongoing annoyance for the next 3-4 years.
 
Hopefully you will be able to get a decent amount for diminished value in order to alleviate some of your concerns about the future. If you think the insurance company is trying to low ball you on the amount there are companies out there to help fight/get comps, etc for a fee. Good luck and let us know how it turns out.

State Farm is my insurance company and they told me that i have to get diminished value from his company and it is covered under the liability coverage, State Farm will repair my car under my coverage but they don’t include diminished value, and they will seek reimbursement from his insurance for the property damage.


His max property is $5,000 which won’t even cover the damages. My agent figured the dismissed value using their formula at $4495. Repairs and dismissed value will equal $12,000, so my only option is to sue the kid in small claims for anything above his coverage.

I could be wrong but I think you can only sue for losses you incurred. Since your company will be paying for the repair, you are only "out" the diminished value and any deductible. His coverage will not come into play as you are going after him directly, that would be between your company and his.

Yeah, I bet that will go well. You may end up getting his total assets like an iPad and a few CDs. Good luck.
