HELP NEEDED!

Holy crap this sucks!! I can't imagine how mad I'd be....

I would have already talked to a lawyer. Know this: the dealership is not going to have your best interests in mind, no matter what they say.
 
They've got insurance. They should buy you a replacement car.
 
I don't doubt that the service manager was nice.............. you have that dealership by the balls.


Follow these steps:

1. Give me, at NO COST to me, a new equivalent car. If yes, we are done. If no, go to step 2 without hesitation:

2. Get a lawyer. Sue them for the entire book value of your car, a cash amount for your inconvenience and any costs you may have incurred in the interim - lost wages, bus fare, whatever (plus legal fees).

That actually seems like the best course of action on that. Thanks for the advice
 
Honestly, water doesn't usually cause issues today. If it is wet in the headliner... I'd want a new car.

Mold in the headliner will occur. And no, I wouldn't let them replace because it'll never be free of rattles.

IMO, the water intrusion totaled the car, same as a flood. Mold and corrosion can pop up a year later.

That said, it is no different than how many other cars damaged. In this case, no physical injuries, just mechanical. I'd expect the same settlement that I'd get if my car was sitting on the street and got hit by a big truck. Simple negligence.

If the insurance company and dealer are smart, this is easily settled in a couple of minutes. Do you want the same color on the new car we are giving you?
 
Honestly,I know you said you don't want another Genesis, possibly, but that is the best way to be made whole. Insurance will pay the current value of the car and so if you are upside down the dealer can make you whole. They'll want to with their stock instead of cash.

If you have gap insurance on your insurance policy, you’re covered for the full balance of the loan, not just the resale value. Gap insurance covers you up to the first 3 years of a new car, after that it’s considered used.

Yeah, but the OP shouldn't have to touch his insurance. The dealer can claim on his.
Yeah that’s true. Shouldn’t have to put the claim in with his insurance since he wasn’t the cause of the mishap.
 
So I am still waiting on the insurance company to do whatever it is they do...

I've been thinking about it and I think that I will be getting another G70 - 2020; probably the Sport trim now (or should I stay with the Prestige?). I'm thinking that I'm going to go with a different color this time...stuck between the Siberian Ice and the Black Forest Green...any ideas?

Subjectively, I think Siberian Ice is gorgeous. Objectively, BFG is probably the most rare.

BFG was rare b/c it was a limited edition (in the USA). Starting in 2020...it's just a regular color now...so perhaps more will show up. Prestige lets you pick interior leather of brown/saddle, black or gray/silver. Sport is only black with grey stitching.

I did like the gray interior...it looked amazing, but I don't mind the black with the red/gray stitching
