Sunday morning a lady blew through a red-light and turned right in front of my son in a 45 mph zone. needless to say an accident occurred. Yes, but you need the right compound. Your dealer has some that sells for about $15,000 and they will apply it for you.

Probably won't make much difference for you in the end but I hope they find her and toss her in jail.

I estimated about $18k. the car drives fine, no leaking fluids. unibody is tweaked though. Front passenger door is up against the passenger fender so I dare not attempt to open it. Door is perfect. The ladies insurance offered me the max per her PIP coverage...... $10k. If my insurance pays anything on this they are going to raise my rates. I pay freaking full coverage for a reason I thought. Insurance is such a rip-off. Not my sons fault but my rates will go up because the lady had only PIP.... crazy

What a terrible accident! Sorry for you and your son. I hope he's OK.

Do you have it in writing that your insurance premium will go up for a not-at-fault collision? Is there a FL state law that let's insurance providers increase premiums for incidents that they pay out on, no matter the liability?

My insurance carrier will take the coverage limits of the other party's policy, and/or go directly after the claimant for the remainder of the damages. But an increase in premium wouldn't happen.
 
I thought PIP was an add on and not something you can have by itself? The minimum should be liability insurance (PDL) which should cover to pay for the damages to your car. PIP is to cover injuries/medical.

Btw, Hope your son is ok and you guys get everything sorted out.

This, my understanding is that PIP is in addition to regular liability insurance. Someone's lying to you.

If somehow she was only provided PIP ... then the insurance company is on the hook for not providing her proper coverage.

I think it would be a good idea to talk to a lawyer about this and see what your rights are, cause something definitely doesn't seem right.

Your insurance company will probably sue the other insurance company for the extra damages
 
We had a similar incident. The kid at fault claimed to have insurance, but it turned out that he took out the insurance after the accident. Our insurance said that this claim would not cause any increase in our rates. (Then they dropped us - one too many claims, my kids had a few claims before this.)
They did say that they would sue the kid for their expenses and our deductible. However they changed their mind. He was a foreign student.
 
I thought PIP was personal injury protection? It’s usually optional and it covers medical bills from an accident. In Texas you cannot have PIP without regular full coverage. I normally reject PIP since I already pay for separate medical thru work. I got rear ended two years ago so that wasn’t something I caused and I lost a discount for ’claim free’. I carry accident forgiveness too so my insurance will not go up regardless who was at fault. If policy limits are hit on the other persons policy, your policy should fill in the gaps to repair your car. Your insurance will then seek subrogation from the other party.

Unfortunate and unbelievable. Yeah I think you're in the right ballpark with 18K, maybe slightly high. I thought about 15K. The estimate on mine, which doesn't look as bad as yours, was 9100K. But the headlights alone are probably 1500-2000 for a set.
 
From what I'm reading that driver had the minimum allowable insurance in Florida. That minimum seems insanely low. Seems like a number ($10k) that would have been established 30 years ago and hasn't been updated since.
 
$10K?! That’s 2x the CA state PD limit, which to this day is only $5K.
 
This requirement seems pretty common but still quite a bit too low for today's medical and property costs:

minimum coverage of $25,000 for bodily injury or death of one person in any one accident; $50,000 for bodily injury or death of two or more persons on any one accident; and $20,000 for injury to or destruction of property of others in any one accident.

Note that this does not mean the person that caused the damage is not responsible for all the damage. That person could be sued if the interested party things they have any chance of actually recovering damages and that it'd be worthwhile after the lawyers get their piece of the pie.

You are correct. The at fault drivers adjuster contacted me today. The lady did NOT have PIP. She only had PDL with a $10,000 limit. Additionally, the lady has not returned any calls to the insurance or the sheriffs office. She is in trouble for providing false information.
 
Good news - At least the claimant has valid coverage and a known identity.
