Low milage non CPO does the warranty carry over?

As my search continues, and I have a warranty question that I can not find the answer to ( I searched). I have come across a few non CPO cars that are low on miles (40K, 42K) and my question is since they are under the 60K factory warranty would these cars still be under factory warranty? I have been told by one dealer that it does, and the other that it would not?

Would the warranty still be good till the 5 year or 60K or no?
 
The following information is for US Hyundai's:

The Hyundai New Vehicle limited warranty is in effect for all vehicles up to 5 years / 60K miles, except for items that are only covered for 3 years such as electronics, etc, or 1 year for wear items, etc. This applies to original owners or for used cars (CPO or non-CPO, or private sales).

The 10 year / 100K powertrain warranty is normally only good for original owner, although I thought that is was also good for Hyundai CPO also. May depend on whether the dealer is talking about official Hyundai CPO, or just some dealer-offered CPO designation that is not related to Hyundai. Ask the dealer for the written documention of the CPO program they are offering.
