speeding ticket - need help

hired lawyer, cop showed. Lawyer spoke with cop and he agreed to make a motion to the court to lower the "clocked" speed. All said and done, I'm out 512.00 plus the cost of whatever driving school i hook up with. Upside no points on a clean record! Downside, wife wanted a flat screen in her bedroom - oh well.....

Too bad you didn't get a moving violation (speeding is included in that board category) ticket in New York. Everyone can now get speeding tickets reduced to a non-point violation, which does not increase your insurance premium or put your license at risk. It seems that the idiots in the state government decided to take all the money that municipalities receive from moving violation fines, and after a few months the state then sends the local municipality a small percentage of the fine. These same idiots also added a state 'surcharge' which doubles the amount of the fine. It's all about the money, but instead of robbing the cities and towns, they actually ended up totally screwing the state.

So here is what happens now - whenever you go to traffic court, they ask if anyone wants to meet with the DA before the court starts. The DA's are instructed to offer pleas to anyone with a moving violation. If you pay a non-moving violation fine, the municipality gets to keep ALL of the fine and the money never goes to the state. Therefore you can get any moving violation reduced to a non-moving violation, typically a parking ticket, and all you have to do is meet with the DA before court. Many people simply send in the fine and take the points and the increase in insurance premiums, but they do not have to do that in NY anymore!

This could be happening in other states, if they ask if anyone wants to meet with the DA, that could be a clue.

in NJ getting a lawyer to represent you gets you nothing but a bigger bill if there's no criminal charges involved. even with those depending on what you did can be a waist of $$$$. moving violations are downgraded to a no point violation with a larger fine and most criminal matters are downgraded to township ordinances which carry NO jail time and a few nudred dollar fine. next step, higher up is pre-trial intervention and/or probation, all can be had without an attorney as the prosecutors could care less what happens, unlike the movies you're not treated like "OJ" or Plaxico Burress lol. Even judge is on your side, will make decisions for you if he/she thinks prosecution is out of line (which would only happen by mistake, trust me they don't car). Outside of a 2nd degree or higher crime you don't NEED an attorney... scam.

another tip, if you MUST have an attorney is to find an attorney that used to be a county prosecutor and is well known/liked. they have the most juice and will get you the best deal going. former prosecutors (or relatives of judges, etc. now practicing law)always do better than hack lawyers.
