texting 20ish year old dumb ass rear ended me this morning..

rush hour traffic, stop and go.. a little pickup and we went from 15ish to 50ish then back down to a stop, idiot hit me at speed while I was stopped, never even slowed down.

I had auto-hold on, and the G80 didn't even budge. Kids 25 year old Acura Integra POS bounced off the car.

his POS was lowered so it hit the bottom half of the bumper, broke the rear diffuser, shoved the faux exhaust tips in, and broke the center backup sensors I think as they aren't picking anything up now, also appears to have damaged the blind spot sensors as they are stuck "on" right now showing the lights in the mirrors and HUD.

Showed me an insurance card, but it expired 3 months ago, hopefully it was just an old card he "swears" he has current coverage and will get me the card. My insurance said they can find out, but are handling it as uninsured motorist at this point.

UGH!! Sux. Yeah it used to be I'd always worry about what's going on in front or side of me while driving, now half the time as I slow down I'm looking in rearview checking to see that car behind me is actually slowing down!

That sucks. Amazing how well the Auto Hold works when you get hit. I just felt a "thump" and the other car bounced back a couple of feet. It does not look at bad but is probably more costly than you can imagine. The other PITA is you lose use of your car for a while and use a crappy rental. Today is day 10 for mine in the shop.

Good luck. Maybe invest in a neck brace for when the other guy's adjuster shows up?
 
My heart goes out to ya. Damage to a beautiful car because of an irresponsible driver. There should be a special place in hell for people causing an accident because they were using a phone.

I am really surprised the Auto-Hold kept the car from moving. On the positive side it kept you from lurching forward and damaging the front of your car and the car in front of you.

Like Alfer, I try to be conscious about car behind me when I can in an urgent braking situation. To mitigate this risk:
1) Steer to shoulder if possible (left or right).
2) Seeing stopped traffic ahead, while at speed, I turn on my emergency flashers to warn the driver behind me.
3) At speed don't fixate solely on the car in front me. Look beyond/in front of that car so you brake earlier/more gradually.
4) Avoid driving in a pack of cars (easier said than done in congested areas).

Sometimes you have no options and your just a sitting duck/bulls-eye.

Oh I saw him coming, I was watching my mirror which I tend to do after coming to a stop anywhere.. but I was in the #3 lane and traffic to both sides I had no where to go.. I had a lot of space in front of me, over a car length which is my M.O. in stop and go traffic for just such a situation, my rule is I stop far enough back to see the tires of the car in front of me.

already had the estimate the body shop I will use is walking distance from my office, I've had good luck with them in the past, the estimate is almost $5,000.

The bumper alone is going to be $2,710 for a full bumper with all the sensors and replacement of the impact foam underneath. The faux exhaust tips are $358 PER SIDE. and the lower cowl is $414.

With labor and paint the estimate is $4,985 and that is from an authorized State Farm shop. A dealership would be 30-40% above that if I decide to go to them.

This assumes a full replacement of everything and there is no wiring damage.. I already told the shop and my agent I will NOT settle for parts transfer, everything will be replaced, and then I want a diminished value claim. The car isn't even 3 months old and now it will show on Carfax as a rear ended accident.

I don't play the insurance game, I pay for insurance through State Farm and State Farm will fix my car, if this idiot has insurance then State Farm can go after them that's what I pay them for.. I will not deal with his fly by night garbage insurance company or play their stupid games. Car will be fixed my way not theirs.

This is a prelude to crazy U.S. holiday driving (Labor Day holiday Monday). There will be more out of towners visiting your region, drunk drivers in spirit and spirits.

Switch to ultra defensive driving mode for the next few days or just stay off the roads.

My reasoning is, with damage to the AEB and cruise control module, I have a bit more faith that the dealer has the ability to fix it right if a tech is needed from the service department. Their estimate was at least $1500 more than the insurance company adjuster but that is common. I guess they go out for a couple of beers after work to resolve it.

unfortunately neither the dealership by my work nor the one by my home have body shops, they both farm out the work to 3rd party shops, then tack on a "transportation fee" to drive your car to the other shop.

however the one by my office uses the Fix Auto I am going to as their 3rd party shop, which is also a State Farm approved shop, so I am going their directly and if there are issues that need to involve the dealer State Farm will cover it with a supplemental claim.. So I'm not worried.

Just got back from a drive to get lunch. Lady, cell phone to her ear, blew a stop sign in front of me. I'd have t-boned her on her drivers side if I hadn't seen her. I honked at her and she looked at me incredulously.

Eyes, ears and brain up and on high alert while driving for the next few days.
Close your eyes (take a nap), close your ears (tune out the world) and/or drink heavily (pick your poison) while not driving if you are so inclined.:cool:

Oh no! Mr. Incredible!! I hope the expired insurance card is still good. I’ve carried expired ones myself while still having coverage. As of 2018 all vehicles are mandated to have emergency braking. That can’t happen soon enough. My Dodge Scat Pack Shaker was rear ended by a drunk driver a year ago. I was sick about it.

Today is day 10 for mine in the shop.

Everyone else feels bad for you, but I don't. My wife is on day 30 and counting after being the first car in a line of cars that an idiot commercial driver plowed through because he "saw the cars but just couldn't stop." Her repair cost so far on her 2018 Chevy Traverse is in the neighborhood of $7,500 and it's growing, and that doesn't count the diminished value, her medical bills, or her repeated time off work for medical appointments. My father was out of his vehicle for about two months before he just bought an SUV, and even then the car, a Hyundai Azera, was in the shop another month or so, all because his vehicle was struck in the rear by a kid changing the CD in his car.

I was almost hit this morning by a semi turning right on red because he was apparently tired of waiting for all the traffic. 500 feet down the road I was almost hit by a cop making a u-turn on the on-ramp to the interstate after working a wreck on the on-ramp.

*sigh*

Ok, perhaps I feel a little bad. Wrecks suck about as bad as these drivers do.

The damage in my car isn't visible as much as is yours, but I got the estimate from "my" body shop for ~$5700! hopefully, State Farm's adjuster will approve it on Tuesday next week.

I feel sorry for you....

btw. my car only has 1400 miles on the clock.

Wow, I guess I'm doing ok then. I can't imagine why it would take 30 days, but I don't run a body shop.

I wonder if it is possible to collect on diminished value and how you arrive at a figure. That could be a Judge Judy case. If the 2019s were on the lot I would have considered trading it on the spot. Depreciation would be nasty though.

Since we are in the middle of our process to get my wife's car fixed, I can tell you how we are handling this based on lots of research. First, insurance companies are required to pay diminished value, but they are not required to tell you about it. Second, insurance companies will typically use what's known as "17c" to calculate the diminished value which, if you guessed correctly, is heavily in the insurance company's favor. By the way, 17c is the section in a lawsuit that relates to the formula State Farm used in determining the diminished value in a particular case, but the industry has adopted it as the standard for calculation even though it is not a requirement to use 17c nor is it applicable beyond the very specific case in which it was applied.

In any case, you have to wait until the body shop has the final cost of repairs. Once you have that final cost, you can get a reasonable diminished value by:
  1. Take the KBB value for your car as "Excellent" and subtract from that the KBB value for "Fair".
  2. Seek out a professional diminished value report from a company that does such service. We have found several around us that offer the report for free because they hope to be hired for court.
  3. Review the values you have and pick a number that is reasonable between the two and then turn it in to the insurance company when you ask for diminished value.
  4. Prepare for the insurance company to use 17c to calculate an insultingly low counteroffer.
  5. Counter back and forth until you both settle on something you can live with, or else take them to court. You may have to submit documentation to the insurance company to support your diminished values.

I reported a driver under the influence on Wednesday to 911. Stayed behind him for more than 4 miles and gave the operator cross streets as he was traveling southbound on this 528. I really hope they got him off the road. He almost hit me in the rear end but was able to get it stopped in time. Motor patrol was in the opposite lane going North bound and the guy pulled up over his tee shirt up over his head to cover his face. I knew then he was wasted. Pulled into the right lane and let him go by and followed at least five cars behind.

He almost hit a trailer, crossed over half way into the middle lane and nearly hit a lady, then wiped it back and almost hit the curb. When we finally went by, he looked at me eye to eye and was nearly incoherent. Sad and really dangerous for others.
