Need help understanding the 2015 recall.

Can a dealership make a decision to keep your car right after purchasing it because of a recall? All they need to do is change the fuse.

Not me, because I would have just cancelled the deal as soon as they denied me my ride after signing the documents.

The recall says nothing about not driving the car, so the dealer should have let you have it and just warn you to park it away from buildings until the new fuses arrive.

I would call the police and make a claim that the dealership is keeping your property that you paid for illegally if they will not release your property to you.

But I would have loss a percentage of my down-payment credit score decrease and I had already paid for insurance. Unless I am missing something. I had already signed the contract. They offered to let me out but I need a car.
 
They also stated that it would be a liability for me to drive the car home. Since the dealership offered to deliver my car can't the sales person drive it he did say he would need someone to follow him. Is he covered under the dealership insurance and liability?

Now that makes more sense that the dealership offered to deliver the car to you as a safety precaution. So what is the problem exactly? At first it sounded like that the dealership was just keeping your car from you until May or whenever Hyundai decides to resolve the recall.

You got to make the choice that best suits you. Weigh the risk vs. reward.

Go after them for fraud for selling you a car under recall that you are unable to drive. Was this disclosed before you signed?

That is what they are trying to do. Keep my ir send it to the dealership here in Madison but not release it to me the owner of

No they let me sign then came back and said their is a recall. the car is drivable. They just don't want to release it to me. They offer me another car but had nothing available in the price range I was in. So they said we can't let you drive it but can deliver it but not to me. Only to the dealership. I just want my car. I am willing to release them but would that release them from the repair?if it catches on fire I would be out of a car again.

I understand that sent documents to prove it but the general manager said he was don't comfortable with release of the car to me.

So now the dealership you purchased your from can only deliver your car to another dealership, but not to you directly? This story is not making any sense to me. Hyundai has not published an offical recall, so the dealership should not be keeping the car from you. Hell, even the proposed recall in May states that a owner can drive the car until the incorrect fuses are swapped out.

I hope you figure this out. If this story is true then just call the police and report that the dealership has stolen your car or just return the car under the lemon law.

It's all true I included the report agreeing with what your saying. I will probably have to call the Illinois police on Monday. Thank you for your responses.

If you do call the police. I would state that you purchased a car that the dealership will not release to you even though you paid for it, which is criminal on their part since the proposed recall do not mention anything about retaining a customer car as a solution. Trust me, if you drove away with the car without paying for it; the dealership would send an police officer to retrieve the car from you.

A police officer would most likely just force the dealership to give you your property if the car can be driven and the supporting documents they provide does not state otherwise. Once you signed the papers the car is yours(or banks really); especially if you or the bank paid the dealership at signing.

Note: I would first check with the bank to ensure the dealership was actually paid before calling the police since the car is still the dealership property until they receive the money for the car which could take a week or more to process depending on the bank.

I see. You may be correct however it really not a contract issue.

The car seems to be clearly signed to the new owner and is being held from her due to a recall that has not been made official as of yet. However, the best bet is for her to just either wait for the dealership to perform the recall repair or obtain legal counsel and use the lemon law to get out of the contract if she does not want to wait until May for her car since the dealership sold her a defective car.

I personally would call the police and state the dealership is holding my personal property without due cause. Police can mediate in some cases if the issue is cut and dry. Hyundai has not issued a recall that prevent the car from being driven by owners or any recall as of yet, so the dealership is clearly wrong to deny the owner her car at signing if payment was made.

The real question is did the dealership let her test drive the car and then take it away from her at signing?

The story does not add up to be honest.
