Now that makes more sense that the dealership offered to deliver the car to you as a safety precaution. So what is the problem exactly? At first it sounded like that the dealership was just keeping your car from you until May or whenever Hyundai decides to resolve the recall.They also stated that it would be a liability for me to drive the car home. Since the dealership offered to deliver my car can't the sales person drive it he did say he would need someone to follow him. Is he covered under the dealership insurance and liability?
You got to make the choice that best suits you. Weigh the risk vs. reward.But I would have loss a percentage of my down-payment credit score decrease and I had already paid for insurance. Unless I am missing something. I had already signed the contract. They offered to let me out but I need a car.

No they let me sign then came back and said their is a recall. the car is drivable. They just don't want to release it to me. They offer me another car but had nothing available in the price range I was in. So they said we can't let you drive it but can deliver it but not to me. Only to the dealership. I just want my car. Go after them for fraud for selling you a car under recall that you are unable to drive. Was this disclosed before you signed?
Make a simple document stating that you will not hold the dealership liable for any problems associated with the recall.

So now the dealership you purchased your from can only deliver your car to another dealership, but not to you directly? This story is not making any sense to me. Hyundai has not published an offical recall, so the dealership should not be keeping the car from you. Hell, even the proposed recall in May states that a owner can drive the car until the incorrect fuses are swapped out.
I hope you figure this out. If this story is true then just call the police and report that the dealership has stolen your car or just return the car under the lemon law.

If you do call the police. I would state that you purchased a car that the dealership will not release to you even though you paid for it, which is criminal on their part since the proposed recall do not mention anything about retaining a customer car as a solution. Trust me, if you drove away with the car without paying for it; the dealership would send an police officer to retrieve the car from you.It's all true I included the report agreeing with what your saying. I see. You may be correct however it really not a contract issue.It's a civil dispute of a contract, police will not get involved.
