F%$&*in Insurance

Early welcome to the R-Spec club (not the Black R-Spec Club) but still "Da Club."

Well dark grey is fairly black, could have been worse had there only been white left. :D Thanks for the welcome, just ordered my emblems and caps from ebay. ;)
 
Maybe I am wrong, but it sounds like he "borrowed" you car for a joy ride, and not because he needed to go somewhere. If so, that is especially bad.

Regarding the insurance, if someone borrows your car, would an accident normally be covered under the car owner's insurance, or the driver's insurance? I am a bit ignorant about that. Also, wondering if the fact that you did not give permission would affect the coverage (if insurance company knew about it)?

This is the reason we buy insurance. Frankly the reason we'd buy it even if the law didn't mandate it as it does in most states -- to cover events like these. An accident like this is definitely covered either by the driver or the owner's insurance. Since the driver doesn't have it, the owner's insurance steps in to cover it. It is not considered a collision, but is covered by the comprehensive provisions of US policies and it doesn't affect rate coverage. By the way, it wouldn't matter whether permission were given or not in order to get the insurance company to cover this claim. Although if the accident occurred through the use of car by a person you gave permission too, the insurance company is entitled to send you a rider asking that you not allow the individual who caused the claim to access to your vehicle again.

He borrowed it without my permission which is what the official report says and no I am not responsible, he is. Technically I have to charge him with theft which would be a criminal offence and no I will not do that unless the insurance company for some strange reason would force my hand. In this case he has no insurance however mine does cover it and the record is against him for future costs/penalties. I still have a clean slate.
Even if there is no criminal complaint filed, I wonder if they would persue a civil claim against him for damages.

I can confirm this as I've been told I'm crazy for many years and I've owned gray vechicle's since 1990. ;)

I guess it didn't help riding big gray ships for 30 years either.

You know, if you look at it logically, we may not be too far off in left feild but it may be those who stare at the color black that are.

When is the last time you saw a black ship or airplane in the military? 95% of them are gray. :)
