All cars have some miles on the OD when they are delivered to a customer. A demo, that has been driven but never tilted, is still considered to be a new car in all states I know of. However, most manufacturers will start the warranty clock running after a certain amount of time past assembly date, even if the car has not been titled yet.
Many states require that the buyer sign a statement at closing acknowledging the miles on the OD for the car they are purchasing, so they can decide for the themselves if they want to purchase that car for that particular price.
