Just wanted to get the thoughts of others to determine if I am dealing with a shady dealer or just being paranoid.

I am going to purchase a new 2016 Genesis in another state. After finally agreeing on a price and having the salesman draw up the purchase order I asked him to send it and sign it so that I can then sign it and forward it on to my bank in order to get the funds/check released.

So far the dealer has been very cagey and has been trying to get me to work with the bank to get the funds released prior to sending the paperwork (i.e. signed PA, odometer statement, title docs,etc). I have been steadfast in wanting the dealer to sign or initial the paperwork (i.e standing behind the deal) given the large rebate involved.

There are a few more details to the story but suffice it to say things have had a different tone since I refused their financing and went with my own. Is this dealer being shady or am I being paranoid. When buying remote who typically signs first the dealer or the buyer?
 
I am not from the States but I can't think it matters who signs first unless you are worried about them changing the terms after you sign - which would amount to fraud anywhere. If you are seriously worried about that level of dishonesty then don't do the deal.

I am totally with you on not getting the funds released until the purchase agreement is signed.

Have you checked out the dealer on line - complaints from former customers and that sort of thing?
 
Ultimately, I will be the one sends the purchase agreement to my bank but I would prefer they sign first so that I can be sure that any fully executed agreement is 100% accurate. The dealership keeps insisting that once they have the funds they will route paperwork for signatures...it just seems backwards to me. I prefer that they dont have the car, money and my signature first. Seems like they would have lots of leverage to make last minute changes.

Since I'm remote I'd prefer to sign last so I can make copies of a fully executed agreement.

  1. Are you picking up the car, or having it shipped?
  2. How would you get funds released if you were buying it from a local dealer?

Will the dealer match your financing offer? Offer them a chance to meet it - odds are they still make something rather than nothing if you go elsewhere.

Agreed. And I would not stand for that.

At this point, I am satisfied with my banks rate and I'm annoyed at the dealership since the rate they quoted was far higher than I received elsewhereverything and what I deserve given my strong credit score.

It's business, forgot pride or vengeance. If you can get the same bank rate and it makes for an easier sale, who cares who gets the few micro points of interest?

My 2015 Genesis lease deal was a horror as when I came to pick up the car and make final payment I found charges that previously "verbally" were agreed upon to not be there were buried in the lease. Being excited to pick up the car, they know you'll go along with subtle changes or additions. You live and learn!!

I had a Nissan dealer in the DFW area verbally agree to a price (on a 2003 Nissan Altima V6, 5 speed) and then when it was time to handle the financing the monthly payments did not add up to what I had calculated with my laptop/spreadsheet. When I confronted them about the discrepancy, they had tacked on the typical dealer "undercoating" fee. They tried to claim it was irreversible. They also assumed that since I'd flown into the DFW area to take delivery of the car, that I was stuck. I proceeded to call an airport shuttle and arrange a flight back to Austin, and that's when they realized I wasn't messing around. After talking to the "finance manager" they agreed to "do me a one-time favor" and remove it.

Dealers are usually scum.

It is exactly why the dealership will not sign it. People walk from 'small' deposits all the time. Your bank does not need the signature from the sales manager to cut you a check. If the deal is not what they said it is upon taking delivery then walk with said check.

Small deposit =$500...I think you may be missing my point that I am doing everything remotely so the bank will send the check once I forward on a signed purchase agreement so the timely routing of the documents is important since nothing is being done face to face and the dealer doesn't have e-sign capabilities. I am going to have the vehicle shipped.
 
this is a hyundai dealer man, not carlitos used car lot. dont worry too much

After a wait for the dealer to locate the car I wanted, I made a deal with a local dealer for a 2016 ultimate AWD ibiza blue, which is exactly what I wanted. I went to pick it up and it was out in front, ready to go. I was doing a walk around with the salesman and I mentioned I wanted to see the window sticker to make sure of what I was getting. He hemmed and hawed a few seconds and said, "oh, did I mention this is a 2015?".

As steam started blowing out of my ears he tried to tell me that "this blue is not available in the 2016", then "this is exactly the same as a 2016, even the price is the same". My guess is they hoped to slip this by me and I'd be none the wiser. This is a dealer where our family has bought 5 previous cars over the years.

Needless to say I canceled the deal on the spot and they will never see me again. I went to a smaller dealer nearby that afternoon and within 2 weeks had the car I wanted.

Man that's pretty pathetic. I'd have been livid. In fact, I would have written HMA cc'ing the GM of the dealer, just so when these morons apply to become a Genesis Brand dealer, that this kind of behaviour is taken into account.

That is both scummy and stupid. And for sure I would do as suggested above and let the powers that be know about it.
