The Lemon That's Not A Lemon, According to Hyundai

I leased my 2015 Genesis sedan (V-6, RWD, Ultimate) in Nov 2015. Since then I have had a ridiculous number of problems. I have taken it into the dealership a total of six different times and it has been in the shop over 100 days total. When I tried to do a lemon buyback last year, they denied it because at the one year point, in Nov 2016, it had only been in the shop for 27 days and the different issues had only been "fixed" three times, rather than the 30 days and/or four repair attempts required by NV Lemon Law.

My issues have been:

1. The standard sunroof rattle. Been in five times for that now, still not fixed.
2. A ticking noise in the drivetrain on cold starts that lasts for 2-3 min. Been in four times, still not fixed.
3. Driver's window switch inop three times. Finally fixed when they replaced the motor.
4. A check engine light after fueling the car, followed by auto-acceleration and a non-responsive gas pedal, requiring a restart to fix. Happened three times and finally fixed.
5. On the repair trip prior to the current one, in which it was in the shop 51 days, the dealership scratched the paint in two spots and chipped it in another.

The car has been in the shop again since 4 May for the sunroof rattle, ticking noise, and paint repair. As previously mentioned, it is at over 100 days in the shop in the first 19 months of ownership. I have had all kinds of rentals and loaners during that time, but it is getting old. The dealership has had Hyundai engineers out twice to look at my car which obviously hasn't worked. This has been the single most aggravating (and expensive) car I have ever owned. Having to continue this for the next 17 months until my lease is up is going to drive me up the wall.

On a positive note, Hyundai did reimburse me three months worth of lease payments. This time, rather than get me a cheap piece of junk rental, they gave me a 2017 G80 with the 5.0 V-8, which is fun. Driving a nice loaner while they reimburse me my lease payments isn't the worst deal in the world, but this whole experience has been terrible and Hyundai/Genesis won't be getting my business again for a long time, if ever.
 
Whether a car is a lemon is not up to Hyundai or even you--ultimately, a court of law will decide or arbitrator depending on your sale agreement and how the lemon laws work in your state. I would advise getting an attorney who specializes in lemon cases. In many instances, they take these with no cash up front from you.

Complicating your case is that most of your issues seem to be resolved. The ticking upon start up when cold could simply be the extra fuel that is injected to warm up the cats, so indeed it may be a "characteristic" of the car. I recently drove a MB C300 that sounded terrible at idle on start and only sounded ok once warmed up. Due to emissions, a lot of direct injected cars dump fuel at cold start.

The sunroof may not be a big enough issue to get a lemon award either. Again, I suggest speaking to an attorney. No car can be completely silent so they may just mark it down to normal creaks and not award a lemon verdict.

Wow, you really have been through a tremendous amount of trouble with this lease. As you said, the positive is that Hyundai reimbursed you for three months of lease payments and is giving you an upgraded and improved loaner. Hopefully, when you voice your well earned displeasure (along with the documented troubles) when your lease is up, the Sales Manager at the Genesis/Hyundai dealership will try to make up for your unfortunate experience with an exceptional new offer on one of those great looking 2018 Genesis'!

The ticking noise isn't normal. I've driven loaner cars identical to mine that didn't do it. Even the engineers were stumped about it. I may resort to speaking with an attorney, but like you said, the remaining problems are so minor (just annoying) that I don't know how much of a chance I would have in a court. I would hate to go to court and lose and have to pay legal fees.

Haha, yeah...I'm sure they will. But I won't touch another Hyundai/Genesis product for a long time after this experience. My prior two car leases (2011 Sonata and 2013 Azera) had no issues, so it's really disappointing to lease a far more expensive vehicle and have nothing but problems.
 
Maybe corporate could get you out of your current lease and into a G80. Would that be an option?

Not sure I would want to. Every Genesis/G80 loaner I have had (three) during this process has had that annoying sunroof rattle. Huge design flaw that is embarrassing in a car in this price range.

The new (slightly revised) 2018 G80 is just now arriving at some dealers. I wonder if they fixed the problem.
