  • Hint: Use a descriptive title for your new message
If you're looking for help and want to draw people in who can assist you, use a descriptive subject title when posting your message. In other words, "I need help with my car" could be about anything and can easily be overlooked by people who can help. However, "I need help with my transmission" will draw interest from people who can help with a transmission specific issue. Be as descriptive as you can. Please also post in the appropriate forum. The "Lounge" is for introducing yourself. If you need help with your G70, please post in the G70 section - and so on... This message can be closed by clicking the X in the top right corner.

The V8 Genesis Badge - Winged?

If the car is produced overseas and isn't a US company (badge included) is it still bound by US Trademark laws? There is no worldwide trademark office, correct?

I think you have to register the trademark in each respective country you want to protect your intellectual property rights in. Examples of competing copyright filings are Cuban Havana Club rum or Czech Budvar beer...

I didn't know this was such a big deal! We purchased the car directly from the dealer with the wings already installed on the trunk. I don't even remember them having any Genesis' on the lot with the Hyundai "H" on the trunk.

In fact, there's a dealer in Seattle (Doug's Hyundai) that has a Genesis with both badges installed:

Direct from factory or dealer installed...hmmm. Either way, it's catching on..

Yes, Hyundai would be bound by US Trademark laws (Lanham Act) if it wants to conduct business within this jurisdiction. There are international intellectual property treaties that protect trademarks internationally. It is called the Madrid protocol, but not every country is a signatory on the treaty, so it's not very reliable with regards to predicting outcomes. International IP law is one of the most developing areas of the law here and abroad based on the globalization phenomenon.

"The dealers, purportedly, are supposed to sell the Genesis models in a separate area away from the other Hyundai models and have a specially-trained salesforce."

Well, maybe somewhere...but not where I bought mine! The sales rep had recently come from a local Ford/Nissan conglomerate in our area. Not a bad guy, but not specially trained regarding this car, and it DEFINITELY wasn't in any 'special area'.

Not that any of that stopped me from buying.....:>)
