2 weeks after genesis purchase, i get rear ended

So I buy my Black on Black premium plus genesis from Pohanka Hyundai in Maryland 2 weeks ago and tell me how I was parked outside of the strip district in pittsburgh, PA and this idiot woman rear ends my car, and guess what? I was parked...and this is like after the G20 summit so there are like no cars on the road...I flagged a cop down got her info and called state farm...i was so mad...the before and after pics are shown...since this is my time i was in an accident any idea of what will happen? the muffler is was on the floor the trunk wont open now and the right side is also damaged though it wasnt shown in the picture...the idiot who hit my car airbags were deployed if that matters...

The other driver musta been going at at least a fair clip if the airbag deployed, right? Or was she just trying to parallel park???

Know how they say most accidents happen within 25 miles of home? Well, if it is any small consolation to you, my husband got nailed in our own driveway! TWICE!!! :eek: :eek: He bashed in the back fender of his new vehicle in the first week of ownership while backing up in our driveway!!! Paid $800 to fix it (didn't want the insurance to fix it and raise their price to us). Guess what? A week later, that same fender got a stick stuck in its side ...that stick protruding from a pallet of garden stuff that had been delivered and was stationed in our driveway. He negotiated around the pallet, but didn't see the darn stick!!! It ain't just idiot women out there...sometimes it's just rotten luck.

that sucks. But, you weren't hurt she is fixable. THough I know the feeling you had in your gut when you saw it.
 
That sucks! What's wrong on the right side? Does the rear door open?

From the pic you linked, its at least a new rear bumper cover, fender, trunk, new steel bumper, maybe replace the subframe, exhaust system, tail lights, and paint. I'm gonna guess $5-8k in damages, but let us know what the adjuster quotes.

What was the woman driving?
 
she wasnt trying to parallel park she was driving normally and either fell asleep at the wheel or was driving and texting and hit my car...she is quite stupid if you ask me but at least no one was hurt and she stopped. All the door s on my car open, there are just alot of body damage on the right side since she pushed my car on the side walk a little bit. and the woman was driving a old caddy, like from the early 90s or something.
 
Damm that hurts. it's my worse feeling driving in NY that a yellow cab will hit me or the old people in LI who can't see.
 
Not sure if there is anything worse than bringing home a brand spanking new toy, only to have it break (or be broken in your case)! What a shame. Good luck with the repairs.
 
adjuster said it will be $12,500 in repairs, all OEM hyundai parts the parts alone are 6k...im in a rental jetta now. it will take 23 days to repair, I hope when i get her back she rides the same

sad to know... but please make sure you will claim the Diminshed value to the offender.
My Sienna got hit after like 6 months on the road, the repair bill is 18K and I got 8K on DV from the insurance.

I am located at Ohio and Ohio court has a strong opinion on the DV. Even we have the court backup, I still need to go more than 4 months before I see my check.
You basically don't need a lawyer but you will need a Surveyor to back up the case. I am using a surveyor (you can PM me for their contacts).

Few things in mind.
1. You must have a police report to claim they are at fault before you can go after them. If they are not at fault, you can still go after your own insurance but the case will be more difficult per the research I did last time.
2. The offender insurance will do everything possible to denie your claim. And if you want to go this route, you will need to be patient and stick to your course
3. And you must keep all your records and don't talk to them, write to them instead and keep a copy of everything and using the delivery/signature confirmation when send it to them.
4. Then the game begins and you may end up collecting 80% of your surveyor value which is fair in my opinion.

Like I said, my minivan got 18K damage and I got 9K estimates DV and finally get a cut of 7.5K (80% of it).
